Boxer Home Inspection Agreement

BOXER HOME INSPECTION LLC SERVICE AGREEMENT THIS AGREEMENT,        made this   day of               by and between;  Hereafter referred to as the Client, and Boxer Home Inspection LLC;  Hereafter referred to as the INSPECTOR. WHEREAS the Client now resides at                            NOW, THEREFORE, in consideration of the premises and mutual agreements herein contained, it is understood and agreed as follows: 1)       The CLIENT agrees to make available to the INSPECTOR the dwelling located at                                          for the purpose of a home inspection.   The INSPECTOR will conduct a visual inspection according to the standards, procedures  and regulations as outlined by the LLR South Carolina Builders Commission which has adopted the ASHI Standard of Practices.  2)       INSPECTOR shall submit a timely report of inspection results to THE CLIENT and INSPECTOR shall be paid $ _ _  dollars at the time of the inspection.  3)       LIMITATION OF LIABILITY:  IT IS UNDERSTOOD AND AGREED THAT SHOULD BOXER HOME INSPECTION LLC AND/OR ITS OWNERS, AGENTS OR EMPLOYEES BE FOUND LIABLE FOR ANY LOSS OR DAMAGES RESULTING FROM A FAILURE TO PERFORM ANY OF IT’S OBLIGATIONS, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, BREACH OF CONTRACT, OR OTHERWISE, THE LIABILITY OF BOXER HOME INSPECTION LLC AND/OR ITS OWNERS, AGENTS OR EMPLOYEES SHALL BE LIMITED TO A SUM EQUAL TO THE AMOUNT OF THE FEE PAID BY THE CLIENT FOR THIS INSPECTION AND REPORT.    4)       This inspection and report are not intended to be used as a guarantee or warranty, expressed or implied, regarding the adequacy, performance or condition of any inspected structure, item or system and any visual problems observed should be verified with the appropriate contractor, electrician, plumber, mechanical engineer, or skilled professional for cost estimates and code compliance.   5)       The Purpose of a residential inspection is to establish a minimum and uniform standard for inspectors and are intended to provide the client with objective information regarding the condition of the systems and components as they exist on the day and time of the inspection. 6)    The Scope of the inspection is a visual observation, with limited use of mechanical instruments, of readily accessible areas of the building, mechanical systems and appliances. The Inspection is limited to areas and systems identified as follows: Structural Components, Exterior, Roofing, Plumbing, Electrical, Heating, Air Conditioning, Interiors, Insulation and Ventilation, Fireplaces and Fuel Burning Appliances. The inspector is to identify and disclose observed general conditions and is limited to readily accessible areas. No disassembly or activating of equipment that has been “shut down”, opening of walls, moving furniture, appliances, stored items or excavation is to be performed. Concealed, camouflaged, or inaccessible conditions may not be exposed. This inspection does not determine if any appliance or device is now or has ever been recalled. Any photographs in the report or on file may not be used in lieu of written documentation.  7)       Systems and conditions that are not within the scope of the inspection include but are not limited to: environmental hazards (e.g. lead paint, formaldehyde, toxic or flammable materials, asbestos, radon, chinese sheet rock; mold; wood fungi; air and water quality (including odor); or any environmental hazard known or unknown; pest infestation, portable appliances (e.g. washer, dryers including dryer vent piping, window air conditioners); security systems, telephone or television systems, identifying buried tanks; window screens and window hermetic seals; fire or lawn sprinklers, swimming pools, spas, or jetted tubs, tennis courts, playground or other leisure appliances or equipment, below ground septic or drainage systems; water wells; zoning ordinances; or any items considered cosmetic in nature; lighting pilot lights: outdoor sheds and fences. Any general comments about these systems and conditions are informational only. 8)           In the event of a claim against INSPECTOR, CLIENT submits to the following minimum conditions: (1) Notification of adverse conditions within fourteen (14) days of discovery, and (2) access to the premises to investigate client’s concern by the Inspector or by qualified contractor hired by the inspector to verify adverse condition before any repairs initiated by the client or clients contractor has begun. Alteration of the home after the date of inspection invalidates any right to remedy. Failure to comply with the above conditions will release INSPECTOR and its agents from any and all obligations or liability of any kind.  9)       Inspection reports are for the sole use by THE CLIENT who gives INSPECTOR permission to discuss observations with real estate agents, owners, repair persons, and other interested parties. INSPECTOR shall be the sole owner of the report and all rights to it. INSPECTOR accepts no responsibility for use or misinterpretation by third parties. 10)     SUBFLOORS: When subfloors are covered by insulation or obstructed by any other covering it is understood that either none or only a portion of the wood structure is visible. The inspector is not liable for any flooring defaults that may be hidden beneath insulation or covering of any kind. Client should consider evaluation by qualified contractor when floors are insulated or covered. The inspector accepts no liability for hidden defaults that are not readily visible.  

11)       If any paragraph of this agreement is invalidated by court only that paragraph is struck. All other paragraphs shall remain valid.

AGREEMENT: This contract represents the entire agreement between BOXER HOME INSPECTION LLC and the CLIENT. BOXER HOME INSPECTION LLC is not responsible for the repair, replacement or alteration of any item within or upon the inspected property.  The CLIENT acknowledges they have read, exercised their own meaningful choice in determining to accept the terms of the contract, and understand the extent and limitations of this inspection and agree to all of the limitations, terms and exclusions contained within this contract including the Limitation of Liability clause found in paragraph two (3) of this contract.
